Terms and Conditions of Contract

A. DEFINITIONS
You = are the customer
The Carrier = is ROSS SMEDLEY GENERAL CARTAGE
The goods = are each single item to be collected and delivered pursuant to this contract
The service = means the collection and delivery of the goods.

B. WHAT THE CARRIER WILL DO
Supply one truck and one driver
Collect the goods from the address agreed with you.
Deliver the goods to the address agreed with you.
Deliver the goods within the timeframe agreed with you or, if there is no
agreement, within a reasonable time of collection.

C. WHAT YOU WILL DO
Insure the collection and delivery point access has adequate clearance and
acceptable contour for the collection/delivery vehicle.
Have the goods ready for collection at the agreed time.
Pack the goods prior to collection.
Ensure the goods are of a non-hazardous nature.
Supply labour or lifting equipment to load/unload heavy and bulky items.
(Carrier can supply at additional cost, Arrange when ordering services)
Ensure the goods comply with the requirements of any applicable law as
to the carriage, packaging and labelling of goods.
Pay the price agreed for the service by the time agreed.
Pay interest at the rate of 24% per annum compounding for any amount
not paid when due.
Pay debt collection costs if such are incurred by the carrier to recover any
amount due.

D. LIMITS ON THE CARRIERS LIABILITY
The goods are carried at limited carriers risk as defined in the Carriage of
Goods Act 1979 by which the carriers liability is limited to $1,500.00 for each
unit of goods lost or damaged.
The carrier has no liability for any loss or damage consequential upon loss of
or damage to the goods.
Where you are a business as defined in the Consumer Guarantees Act 1993,
it is agreed that you are acquiring the service for the purpose of a
business and that the Act does not apply.

E. GOODS NOT ABLE TO BE DELIVERED OR UNCLAIMED GOODS
The carrier may store goods not able to be delivered or unclaimed goods.
You will pay the costs of such storage and if the carrier agrees to deliver the
goods to another place, the costs of such delivery.
The goods are stored at your risk (owners risk).
You authorise the carrier to sell unclaimed goods after 30 days and you agree
to pay the carrier any costs incurred to sell the goods and you authorise the
carrier to deduct such costs from the proceeds of sale.

F. GENERAL STORAGE OF GOODS
When The Carrier agrees to Store Goods for an agreed period and fee,
The goods are stored at "Owners Risk"
All monies owing for storage must be paid in full before the goods will be
released to the owner or owners agent.
The Carrier will take all reasonable steps to make sure the goods are stored
in a suitible dry and safe location.
